Even after your divorce case is final, the work may not be done. Our clients are often surprised that everything may not be over just because the divorce has been signed. The emotionally draining process of exchanging information, settlement negotiations, and even trial may only be the beginning.

Vague or inexact terms:
Every term in your separation agreement or court order should have a firm deadline. If one party is to pay a certain sum of money, list the house for sale, or split retirement funds, each of those terms needs a set deadline. Otherwise, if a party does not comply, the court will not be able to provide a remedy to the spouse that is suffering financial harm as a result of the delay or noncompliance.
Necessity of additional orders:
In the case of retirement accounts, the court and administrator of the account require an additional court Order to distribute the funds. Preparation of Qualified Domestic Relations Orders may be something your divorce attorney can do, or they may refer you to an attorney that specializes in this area.

Agreeing to “something else:
Maybe something has changed since your order was entered, and you and your ex-spouse have lowered child support, or changed the visitation schedule, or moved to a new school district. So long as there is an order in place, you are in violation of the order if you don’t petition the court to change it.
In some cases, ex-spouses may get along for a period of time and believe an obligation has been changed or waived. However, if an issue comes up again, the violating party can be held in contempt of court and sanctioned financially or penalized otherwise.
Even after your divorce is final, you may have additional obligations or need further advice and service of a knowledgeable family law attorney.
